1. Introduction

These Terms and Conditions (“Terms”) govern your use of this website and your purchase of any products offered on it, including the pre-sale of OH, FOR PROPERTY’S SAKE!™ (the “Product”). By placing an order or using this website, you agree to be bound by these Terms. If you do not agree, please do not use this website or place an order.

The Product is sold by The Tarsi Taylor Way (“we,” “us,” “our”), ABN 60 398 968 133, of PO Box 9027, Gold Coast MC QLD 9726, Australia.

2. Pre-Sale Terms

2.1 The Product is currently being offered as a pre-sale. This means the Product is still in development and testing, and stock does not yet physically exist at the time of purchase.

2.2 By purchasing during the pre-sale period, you acknowledge and agree that:

— estimated shipping is November 2026, and this date is our current best estimate, not a guaranteed delivery date;
— shipping timeframes may change due to manufacturing, quality testing, supply, or other factors reasonably outside our control;
— we will notify you by email of any material change to the estimated shipping timeframe;
— final artwork, card content, and packaging may be refined between the pre-sale period and manufacture, provided the core game and its value to you are not materially diminished.

2.3 We will make reasonable efforts to keep customers updated on production progress via email.

3. Pricing and Payment

3.1 The pre-sale price is AUD $99 per copy, plus AUD $9.95 postage per order, unless otherwise stated at checkout. All prices are in Australian dollars and include GST where applicable.

3.2 Payment is processed securely at the time of order through our nominated payment provider. We do not store your full payment card details.

3.3 We reserve the right to change pricing for future orders at any time. Any price change will not affect an order you have already placed and paid for.

3.4 If you register your interest or reserve a copy through a form on this website, your order is not confirmed until payment has been received in full.

4. Shipping and Delivery

4.1 We currently ship within Australia. If international shipping becomes available, additional terms and postage costs will apply and will be communicated at checkout.

4.2 Shipping timeframes provided on this website (including “Shipping November 2026”) are estimates only. We are not liable for delays caused by circumstances outside our reasonable control, including but not limited to manufacturing delays, courier delays, or events of force majeure.

4.3 Risk in the Product passes to you upon delivery to the address you provided at checkout. Please ensure your shipping details are correct — we are not responsible for orders sent to an incorrect address supplied by you.

5. Cancellations and Refunds

5.2 Faulty or damaged goods: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. If the Product arrives faulty, damaged, or significantly different from its description, please contact us at admin@thetarsiway.com and we will arrange a repair, replacement, or refund in accordance with your consumer rights.

5.3 If the Product is not delivered: If, for any reason, we are unable to bring the Product to market and fulfil pre-sale orders, all affected customers will be offered a full refund.

5.4 Where a refund is owed under clause 5.2 or 5.3, it will be processed back to your original payment method within a reasonable time, and no later than 14 days from approval of the refund request.

6. Intellectual Property

6.1 OH, FOR PROPERTY’S SAKE!™, THE CLIENT FLYWHEEL™, THE 13TH QUARTER™, and all associated logos, card content, game mechanics text, and artwork are the intellectual property of The Tarsi Taylor Way, unless otherwise stated.

6.2 You may not reproduce, distribute, publicly display, sell, or create derivative works from any part of the Product, its packaging, or this website without our prior written consent, other than for your own personal or internal team use of a purchased copy of the Product.

6.3 All content on this website (text, graphics, logos, and images) is protected by copyright and other intellectual property laws and may not be used without our permission.

7. Product Use and Age Suitability

7.1 The Product is designed for players aged 16 and over. It is intended for use as a team-based board game and is provided as general team-engagement and educational entertainment. It does not constitute financial, legal, business, or professional advice, and we make no guarantee about specific business outcomes from playing the Product.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law, our liability to you in connection with the Product or this website is limited, at our option, to the replacement or repair of the Product, or a refund of the amount you paid.

8.2 To the extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Product or this website.

9. Privacy

9.1 Any personal information you provide through this website (such as your name, email, agency name, and phone number) is collected and handled in accordance with our Privacy Policy.

9.2 We will not sell your personal information to third parties. We may use your contact details to send order updates, shipping notifications, and — where you have consented — occasional marketing communications, which you can opt out of at any time.

10.1 You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this website by, any third party.
